1. Disclaimer for the use of BlueDolphin during the free trial period

Dear customer,

Your free trial period for BlueDolphin has been activated. You may use BlueDolphin during the trial period and under the conditions set out in this disclaimer.

Right of use. ValueBlue will provide you with one means of access at an email address to be specified by you. The means of access is strictly personal, cannot be transferred to another person and must be treated as confidential. You must immediately notify ValueBlue if you discover or suspect that the access token is being used in an unauthorised manner. You may use BlueDolphin with the access token during the trial period and subject to the restrictions imposed by ValueBlue. This right of use is non-transferable and may be revoked by ValueBlue at any time. You may not make BlueDolphin or parts thereof available or otherwise distribute it to third parties in any way, or publicly display, modify, adapt, copy and/or otherwise reproduce the application and the software on which it is based. All intellectual property rights in or relating to BlueDolphin are vested in ValueBlue and/or its licensors.

Your data. All data you enter into BlueDolphin remains your property at all times. You are responsible for the data you enter. Your data will be deleted by ValueBlue at the end of your trial period, unless you purchase a paid licence from ValueBlue within 15 days of the end of the trial period.

Availability, warranties and liability. BlueDolphin is provided ‘as is’. ValueBlue makes no warranties, express or implied, regarding the accuracy, completeness, reliability, availability or performance of BlueDolphin. ValueBlue does not guarantee that the security of BlueDolphin will be effective under all circumstances. ValueBlue is never obliged to restore damaged or lost data. To the extent permitted by law, ValueBlue is not liable for any loss or damage arising from or related to the use of BlueDolphin, except insofar as such loss or damage is the result of intent or wilful recklessness on the part of ValueBlue.

Prohibited use. When using BlueDolphin, you may not perform or omit any actions that you know or should reasonably have foreseen could lead to nuisance, damage or use of BlueDolphin that is criminal or unlawful towards ValueBlue and/or third parties or infringes their intellectual property rights.

ValueBlue AI. If you have access to ValueBlue AI during the trial period, the following disclaimer applies: Disclaimer Trial Period – artificial intelligence tools.

Applicable law and choice of forum. This disclaimer and the use of BlueDolphin during the trial period and all resulting disputes and claims are governed exclusively by and interpreted in accordance with Dutch law. All disputes shall be submitted exclusively to the competent court of Midden-Nederland, location Utrecht.

By accepting and using the trial period for BlueDolphin, you acknowledge and accept this disclaimer.

Beste klant,

Uw gratis proefperiode voor BlueDolphin is geactiveerd. U mag BlueDolphin gebruiken gedurende de proefperiode en onder de voorwaarden opgenomen in deze disclaimer.

Gebruiksrecht. BlueDolphin verstrekt u één toegangsmiddel op een door u te delen e-mailadres. Het toegangsmiddel is strikt persoonlijk, kan niet worden overgedragen aan een ander en dient vertrouwelijk te worden behandeld. U stelt BlueDolphin onmiddellijk op de hoogte wanneer u vaststelt of vermoedt dat het toegangsmiddel op ongeoorloofde wijze wordt gebruikt. Met behulp van het toegangsmiddel mag u BlueDolphin gebruiken gedurende de proefperiode en onder de beperkingen die daaraan door BlueDolphin worden gesteld. Dit gebruiksrecht is niet overdraagbaar en kan op ieder moment door BlueDolphin worden ingetrokken. U mag BlueDolphin of delen daarvan op geen enkele wijze beschikbaar stellen of anderszins distribueren aan derden, of de applicatie en de software waarop deze is gebaseerd publiekelijk tonen, wijzigen, aanpassen, kopiëren en/of anderszins reproduceren. Alle intellectuele eigendomsrechten in of met betrekking tot BlueDolphin berusten bij BlueDolphin en/of haar licentiegevers.

Uw gegevens. Alle gegevens die u in BlueDolphin invoert blijven te allen tijde uw eigendom. U bent verantwoordelijk voor de ingevoerde gegevens. Uw gegevens worden door BlueDolphin gewist na afloop van uw proefperiode, tenzij u binnen 15 dagen na afloop van proefperiode een betaalde licentie bij BlueDolphin afneemt.

Beschikbaarheid, garanties en aansprakelijkheid. BlueDolphin wordt geleverd ‘as-is’. BlueDolphin geeft geen garanties, expliciet noch impliciet, met betrekking tot de nauwkeurigheid, volledigheid, betrouwbaarheid, beschikbaarheid of prestaties van BlueDolphin. BlueDolphin staat er niet voor in dat de beveiliging van BlueDolphin onder alle omstandigheden effectief is. BlueDolphin is nooit verplicht om beschadigde of verloren gegevens te herstellen. Voor zover wettelijk toegestaan, is BlueDolphin niet aansprakelijk voor verliezen of schades die voortvloeien uit of verband houden met het gebruik van BlueDolphin behalve voor zover dergelijke verliezen of schades het gevolg zijn van opzet of bewuste roekeloosheid van BlueDolphin.

Verboden gebruik. Bij het gebruik van BlueDolphin mag u niet handelingen verrichten of nalaten waarvan u weet of redelijkerwijs had moeten voorzien dat deze zouden kunnen leiden tot overlast, schade of een gebruik van BlueDolphin dat strafbaar of onrechtmatig is jegens BlueDolphin en/of derden of inbreuk maakt op hun intellectuele eigendomsrechten.

BlueDolphin AI. Indien u tijdens de proefperiode toegang heeft tot BlueDolphin AI, dan geldt de daarvoor opgestelde Disclaimer Trial Period – artificial intelligence tools.

Toepasselijk recht en forumkeuze. Deze disclaimer en het gebruik van BlueDolphin gedurende de proefperiode en alle daaruit voortvloeiende geschillen en aanspraken worden uitsluitend beheerst door en uitgelegd naar Nederlands recht. Alle geschillen worden bij uitsluiting voorgelegd aan de bevoegde rechtbank Midden-Nederland, locatie Utrecht.

Door de proefperiode voor BlueDolphin te accepteren en te gebruiken, erkent en aanvaardt u deze disclaimer.
